Conciliation is a method of dispute resolution where the parties in the dispute work with a Conciliator in a collaborative fashion to achieve a mutually-agreed solution, formalized in a Settlement Agreement. If the parties are unable to reach a settlement, the Conciliator will prepare for the parties a written Recommendation on how the parties might best reach a settlement, which the parties may accept or reject. As in Mediation, a result is not forced upon the parties, although some construction contracts may allow a Recommendation to become binding.

Mr. Madden has served as a Conciliator in over two dozen construction disputes on projects including water treatment plants, water and sewer systems, dual-carriageway highways, bridges and residential complexes.
