John P. Madden has been a construction contract mediator throughout the U.S. since 1992.

Mediation is today's best investment and best solution to dispute settlement offering an 85-90% likelihood of success while avoiding costly and time-consuming litigation.

Mediation is a process whereby a neutral third party acts to encourage and facilitate the resolution of a dispute.  It is a voluntary and confidential process with the objective of helping the disputing parties reach a mutually acceptable agreement without prejudice to any other remedy they might seek in the future.

Throughout his career, Mr. Madden has been an effective neutral in cases of varying magnitude in the range of $1 million to $100 million.

Typically, from time of initial inquiry, it takes approximately sixty (60) days to arrive at final resolution of the entire dispute.  At the heart of the process is the mediation itself which usually takes from 1-3 consecutive days and often entails multi-party involvement.

In his first negotiation, for example, at the request of a U.S. District Court Judge in New Orleans and upon the recommendation of the parties' counsel, Mr. Madden resolved a $25 million U.S. government design/construction dispute among four parties in three days.

In 2001, of the approximately 10 construction cases in which Mr. Madden served as mediator, every dispute was resolved.

By using creative strategies tailored to the specific needs of the parties as well as the issues relevant to the dispute, Mr. Madden brings about positive resolution that all parties can live with in a concise and timely manner.  His engineering education and construction background further strengthen his quick and insightful grasp of the facts, allowing him to more easily "debunk the institutional truths", and purge the inaccurate information and misunderstandings which often exist in dispute scenarios.

Mr. Madden has been widely cited both in trade and commercial publications and has, himself, written a number of articles on the subjects of mediation and arbitration.  His article contained in the May-July 2001 edition of Dispute Resolution Journal published by the American Arbitration Association entitled "Recipe for Success in Construction Mediation" offers a concise overview of Mr. Madden's thinking and approach to the mediation process.  These articles can be found through this website under "Articles."
